NO CLASS OR REPRESENTATIVE PROCEEDINGS: CLASS ACTION WAIVER
You and Tickteck LLC agree that any claims brought against each other must be done so solely in an individual capacity, and not as a plaintiff or class member in any purported class or representative action. Unless mutually agreed upon by both parties, no arbitrator or court may consolidate claims from more than one individual or preside over any form of a representative or class proceeding. The arbitrator may only grant injunctive relief in favor of the individual party seeking such relief and only to the extent necessary to address that party’s individual claim.
If a court determines that applicable law prevents enforcement of any portion of this provision concerning a particular claim for relief, that specific claim (and only that claim) must be severed from the arbitration process and may be pursued in court.
